If you are not the only person using your pc and you want to check for and remove spyware, the best (free) product I have found to do this is Ad-Aware.
It is available from www.lavasoft.de (get the update utility whilst your there) and allows you to scan your registry, memory and hard disk for spyware.
It is also updated prety regularly (there were 3 ref file updates in April)

regulation controlling whether spyware can be installed or not (e.g. a mandatory checkbox) is the wrong answer

the market will decide what place spyware has on people's pcs

programmers who want to earn money for their work (shocking concept) by using spyware will be discouraged if no-one uses their software

companies who aggregate and sell marketing data from spyware for money will be discouraged if the data is very low quality or in very low volume

The problem is that there isn't that much publicly available information about a qualitative or quantitative analysis of spyware data returns.
